The discrimination rules applicable to protected employee categories (expectant mothers, disabled employees, elderly etc.) are in continuous development, and throughout the last years the prohibition against discrimination due to age and disability has in particularly been the cause of many cases before the EU Court of Justice and the national courts, which has made it difficult to assess the legal position of the employers.
Damkjær Lauritzen has significant and thorough experience in advising employers on how to ensure compliance with the complex rules on discrimination and differential treatment. In relation to that, Damkjær Lauritzen assists in drafting employee policies, employment processes, amendments of employment terms, long-time illness, dismissals, severance agreements etc.
If compensation claims are raised due to an alleged breach of the discrimination rules, we represent the employer before both the Danish Equal Treatment Board (in Danish: Ligebehandlingsnævnet) and the ordinary courts.
